Subject: open letter to the Minister for the Public Administration on anachronistic and unfair, in favor of local administrators in reference to Arts. 77 and 81 of the Decree. 267/2000 (TUEL).

Dear Sir, I hereby appeal to your attention an issue that prized in recent years has been raised several times, but in my humble opinion, has not seen a solution satisfying the prerogatives of fairness that a modern state should guarantee citizenship, even after the Law n.244/2007.

E 'known to the art. 77, TUEL, paragraph 1, states: "The Republic protects the right of every citizen called to fill positions of local public administrations to carry out the mandate, with little time, services and resources and taking advantage of compensation and reimbursement of expenses in the manner and within the limits prescribed by law .

In this section, we accept all the principles of equity that a democratic state must guarantee each individual citizen.

Paragraph 2 of the same TUEL and art.77 of the above article. 81 of TUEL, instead, begin to glimpse the forms of privilege rather than a guarantee of some of the community and, above all, found an absurd form of guarantee against certain individuals who do not perform the job of mayor or deputy mayor, but the simple task of taking control of City Council.

E’ già molto che l’art. 2, comma 24, della legge Legge n.244/2007, nel modificare l’art. 81, comma 1, del T.U.E.L., ha limitato la possibilità di collocamento in aspettativa non retribuita di soggetti lavoratori dipendenti, per il periodo di espletamento del mandato amministrativo, alle seguenti cariche amministrative locali: sindaci, presidenti delle province, presidenti dei consigli comunali e provinciali, presidenti dei consigli circoscrizionali metropolitan areas, the Presidents of the mountain communities and associations of municipalities, as well as members of the Board of municipalities and provinces.

Not to bore you insist on story-regulatory provisions that are probably already known to you, the reason for my return, it is most necessary to emphasize that what is inappropriate if not absurd, it is considered advice of a town of 7-8 thousand people the same way as the Mayor of Rome for the privilege of such leave, being at least solved the problem of payment of contributions for which it was declared a major difference.

You can say, in fact, that we can all be more or less agree that a Mayor or President of the Province that has responsibilities both objective and subjective figure that directly elected must participate actively in the management of a territory and be the guarantor of the services of a territory, should be able to conduct his business as if it were an elective work and, therefore, to enjoy the privilege of such leave, even if it is paid Ente.

You may not shocked when one considers that this privilege is in favor of Municipal and Provincial Councillors, who no longer have responsibility subjective, but retain a function of land management in support of the Mayor in the organ of local government.

But we can not just turn up your nose if City Council, perhaps a town of 7-8 thousand inhabitants, without distinction between majority and minority, enjoy this favoritism?

We leave the answer to your particular sensitivity on this issue, below a specific case.

E 'is well known that in the City of Fontana in the Province of Padua (community of about 8000 inhabitants), a Municipal Council, an official of the City of Grangemouth in the province of Padua, enjoy this unfair privilege since 2004.

adverse effects for both government and the wider community benefit of this absurdity is easily summarized as follows:

a) cost to the local authority in which the mandate was carried out from June 2004 to December 2007 approximately 30.000/35.000 € payment of contributions to the subject in question, wickedness which ended with the Law n.244/2007; Fontaniva the community wishes to thank the supporters of this waste of public money.

b) cost to the local authority which is carrying out the mandate, from December 2007 to date for completion of administrative procedures relating to the payment of the contributions of the subject in question, the community Fontaniva thanks that they kept the damage but would like them to be completely eliminated.

c) cost to the local authority where you should do the job and instead fill the position without holding it to work, caused by reduction in staffing of the offices of PA Grangemouth, reduction of services, slow performance, inability to change the subject, the Grangemouth community welcomes this great example of fannullaggine.

d) additional cost pearl community in general given by a public place locked, impossible for many unemployed have access to a new job.

Dear Sir, I do not want to give solutions.

I ask you only to find a way to put an end to these unfair situations that create a feeling of hopelessness among the citizens against the State.
